The Municipality of Belo Horizonte published in the Official Gazette of the Municipality on August 02, 2018, Decree nº 16.954, regulating the National Anti-Corruption Law. The Decree establishes the administrative accountability of legal entities for the practice of harmful acts against the municipal public administration.
In relation to Compliance Management, the Decree determines that the Integrity Program of a legal entity must be structured, applied and updated according to the characteristics and current risks within the context of specific activities of each company.
In this way, it defines parameters for an Integrity Program and evaluation criteria from the presentation of company profile report and program compliance report.
Finally, it also emphasizes that “shelf” Integrity Programs, which are merely formal, will not be considered ineffective to mitigate the risk of acts harmful to the public administration.
